Terms of Service

This website and client portal are used by two entities owned by the same person:

• Whitestone Capital, a proprietorship and SEBI-registered Research Analyst (Reg. No. INH000020794), which provides the research services;
• Whitestone Prime Capital Pvt. Ltd., an AMFI-registered Mutual Fund Distributor (ARN-281897) and PMS distributor (APRN08220), which provides the distribution services and operates the website and portal on behalf of both.

In these Terms, “we” means the entity providing the service concerned. Each entity is responsible only for its own services.

These Terms apply when you create an account and accept them in the portal. The following also apply and form part of these Terms: our Privacy Policy, Disclaimer and Refund Policy; for research subscriptions, the Research Analyst Terms and Conditions (MITC) you sign; and for each investment, the scheme or offer documents of that product.

Research reports, model portfolios and research alerts are research opinions. They are not personalised investment advice and not an offer to buy or sell any security. Whitestone Capital does not execute trades, manage money or hold your funds or securities, and never asks for your trading, demat or bank passwords. You decide whether and how to act. Fees, payment and refunds are as set out in the MITC and our Refund Policy.

• Mutual funds: you place purchase, SIP, switch, STP, SWP and redemption instructions yourself in the portal, in regular plans. We send them to BSE StAR MF. Payments are made through the exchange's payment gateway or a mandate you register. Allotment, NAV, cut-off times and processing follow the rules of BSE, the mutual fund house and its registrar; we are not responsible for delays or rejections by them or by banks.
• We charge you no fee for distribution. We receive commission from mutual fund houses (see Commission Disclosure). Direct plans, which carry no distributor commission, are available directly from the mutual fund houses.
• PMS: we introduce portfolio management services; your agreement for a PMS is with the portfolio manager.
• Insurance: insurance products are offered through a licensed insurer or insurance intermediary named in the policy documents.
• Mutual fund and PMS distribution and insurance services are not regulated by SEBI.

You must be at least 18 years old and able to contract under Indian law. Keep your details accurate and up to date. You sign in with a one-time code sent to your registered e-mail address; do not share it with anyone. You are responsible for activity under your account. We will never call you to ask for a code or a password.

Investments in securities and mutual funds are subject to market risks; read all scheme-related documents carefully before investing. Past performance is not indicative of future results. No return is assured or guaranteed.

All content on the platform, including research reports and model portfolios, belongs to or is licensed to Whitestone. Research reports may carry your name and e-mail address as a watermark. You may use content for your own non-commercial purposes only, and may not reproduce, share or resell it without our written consent.

You agree not to: share your account or subscriber-only content; use the platform for any unlawful purpose; try to gain unauthorised access to the platform or its data; disrupt the platform; or present our research to others as personalised advice.

The platform shows data from third parties, such as prices and NAVs, and links to other websites. We take reasonable care but do not guarantee third-party data and are not responsible for other websites.

To the extent the law allows, we are not liable for indirect or consequential loss, or for investment losses, arising from your use of the platform or its content. Nothing in these Terms limits any right you have under SEBI or AMFI rules or under law.

You may ask us to close your account at any time. We may suspend or close an account if these Terms are breached or the law requires. Records the law requires us to keep are kept as set out in the Privacy Policy.

When we change these Terms in a way that affects you, we will publish a new version and ask you to accept it in the portal.

These Terms are governed by the laws of India. Subject to SEBI's dispute-resolution mechanisms, the courts at Pune, Maharashtra have jurisdiction.
